Small World Net is a social media software platform that connects brands and consumers. The services offered by Small World Net Corporation include the Small World Net website, and any brand websites “Brand Partners” that are using the Small World Net platform. By accessing or using our site at www.smallworldnet.com or by using any Brand Partner site that is hosted on the Platform whereby there is a Small World Net visor bar at the top of the web site, (together the "Site"), you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use.
Small World Net Corporation reserves the right, in its sole discretion, to reject, refuse to post or remove any posting and content by you, or to restrict, suspend, or terminate your access to all or any part of the Site at any time, for any or no reason, with or without prior notice, and without liability.
Use of and membership in the Site is void where prohibited. By using the Site, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information ; (c) you are 13 years of age or older; and (d) your use of the Site platform does not violate any applicable law or regulation. Your profile may be deleted and your membership may be terminated without warning, if we believe that you are less than 13 years of age.
The Site will not sell, rent or lease to others your profile data including telephone numbers or e-mail addresses, etc. It will share the personal data you provide only with other Small World Net entities and/or Brand Partners that are using the Small World Net platform that you have become a member of.
When you post content or messages of any kind in on the “Site”, all content on the Site, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of the Company, its users or its licensors with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the Brand Partner’s prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site. Provided that you are eligible for use of the Site, you are granted a limited license to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to these Terms of Use and does not include use of any data mining, robots or similar data gathering or extraction methods. Any use of the Site or the Site Content other than as specifically authorized herein, without the prior written permission of Brand Partner, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.
You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, music, video, advertisements, listings, and other content that you upload, publish or display (hereinafter, "post") on the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the Company violates this Agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.
You may download, view, copy, and print documents and graphics from this Site so long as your use is limited solely to personal, informational, or non-commercial purposes and you do not modify or alter the content in any way.
Except where your use constitutes "fair use" under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this Web site in whole or in part without the express authorization of Small World Net Corporation and its Brand Partners.
You are responsible for maintaining the confidentiality of any password(s) you are given or set to access the Site, and are fully responsible for all activities that occur under your password(s). You agree to notify Small World Net immediately of any unauthorized use of your password(s).
As part of Small World Net’s platform, Brand Partners have the ability to award Brand Badges™ to users. As a user, you have the ability to disseminate these badges into various social networking consumer websites (i.e. Facebook, My Space). Once you have accepted a Brand Badge™ from a Brand Partner, and you have sent the badges to a social networking consumer website, those brand badges cannot be recalled. They are available to other social networking consumer website users to view until you delete them.
We respect the intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the Site any materials that violate another party's intellectual property rights. When we receive proper Notification of Alleged Copyright Infringement we promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers. If you believe that any material on the Site infringes upon any copyright which you own or control, you may send a written notification of such infringement to us at info@smallworldnet.com
You agree that Small World Net Corporation may, in its sole discretion, at any time terminate your access to the Site. Access to the site may be monitored by Small World Net Corporation.
SMALL WORLD NET CORPORATION MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE INFORMATION OR OTHER MATERIALS PUBLISHED ON THIS SITE FOR ANY PURPOSE AND ALL INFORMATION OR OTHER MATERIALS PROVIDED ON THIS SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
